In order to ensure compliance with the legal system and our internal regulations, GRUPO MORILLAS BRAND has created and implemented an Ethical Channel that allows any person to communicate, confidentially and securely—with the possibility of maintaining anonymity—possible irregular conduct, regulatory infractions, or ethical violations detected within our organization, guaranteeing the absence of reprisals for those who make communications in good faith.
This Ethical Channel responds to the provisions of Law 2/2023, of February 20, regulating the protection of persons who report regulatory infractions and the fight against corruption, as well as Directive (EU) 2019/1937, regarding the protection of persons who report breaches of Union law.
All communications will be processed with the maximum guarantee of confidentiality and without risk of reprisals for the reporting person, provided that the reporter acts in good faith and on the basis of reasonable indications or truthful facts.
The use of this Ethical Channel to raise complaints or to communicate false facts, with manifest disregard for the truth or that lack foundation, is prohibited.
What facts can be communicated?
Through the Ethical Channel, you can communicate any fact that you consider may constitute an infraction of the legal system, the Code of Ethics, or any internal regulation in force of GRUPO MORILLAS BRAND. In particular, this channel is enabled to report on:
Essential Principles of the Procedure for Managing and Investigating Received Communications
We understand that confidentiality is fundamental for people to feel safe when communicating facts of which they have knowledge through the Ethical Channel. We guarantee absolute confidentiality throughout the entire process and protect the identity of the reporting person to the extent permitted by law. This includes the possibility of submitting the communication anonymously through the online Ethical Channel (as described below).
Once a communication is received, an analysis and investigation process will be initiated, carried out objectively, impartially, and diligently by the body responsible for the Ethical Channel, in accordance with internal regulations and applicable legislation. Throughout the entire process, the rights of the intervening parties will be respected, especially the right to be heard, to use relevant means of proof, the presumption of innocence, and the right to honor.
GRUPO MORILLAS BRAND expressly prohibits any form of direct or indirect reprisal against those who communicate facts protected by law, provided they act in good faith and with reasonable indications of veracity.
Received communications will be managed with the utmost diligence and professionalism. Acknowledgment of receipt of the communication will be made within a maximum period of seven days, and a response will be given within a period not exceeding three months, which may be extended by another three months in particularly complex cases.
Once the analysis of the facts has been completed, the necessary actions will be taken to correct and prevent irregularities, including possible disciplinary, corrective, or organizational improvement measures. Whenever feasible and without prejudice to confidentiality, the reporting person will be informed about the outcome and status of their communication.
